K.D was 6 years old who has autism and went to Villa Grove Elementary. He was given a service dog name Chewey by from Autism Service Dogs of America (ASDA) .The school sent a letter to K.D's parents informing them that Chewey was prohibited from accompanying K.D. to school. K.D couldn’t go to a summer school program because the school prohibited Chewey. K.D.'s parent filed for a preliminary injunction on his behalf that through the school code K.D was allowed to bring Chewey to school. The school filed to dismiss the plaintiff motion. The court denied the school motion and granted the plaintiffs a temporary restraining order therefore allowing Chewey to be able to accompany K.D. to school. The parents of K.D sought after a trial to require the district to allow Chewey to attend school to train at least one staff member on service animal commands and equipment.
