On January 11, 2002, a special Allen County grand jury formally indicted both Jackson and Cunningham for two counts of aggravated murder with firearm and death-penalty specifications, one count of aggravated robbery with a firearm specification, and six counts of attempted aggravated murder with a firearm specification.
